LVT Case Update

Leaseholders’ Forum’s case

Camden Leaseholders’ Forum have decided, in the end, not to submit our own case to the LVT.  We did this on the basis that the points we wish to make at this stage have been covered by other parties.  Although we have not submitted a case, this does not rule out us making an appeal, depending on the decision made at the LVT.

Clarification: Camden Council are making their case on the basis that the clauses relating to charges in all “B” leases are the same.  Therefore it will only take one respondent to make a valid case against the planned increase in management charges, for that case to also apply to all the other “B” leases.  Given this, the Leaseholders’ Forum do not wish to take up the LVT’s time repeating legal arguments that other respondents have already made.

Next steps

This Monday (17th February) sees the case management conference where the LVT will establish who will be given the opportunity to provide evidence at the full hearing.  This starts at 10am at the Camden Centre, Bidborough Street, London WC1H 9AU.  The case itself will be heard at Hamilton House, Mabledon Place, London WC1H 9BD starting at 10am on each day, currently scheduled for 17th, 18th and 19th March 2014.

That’s it for now!
